This web site is owned and operated by Dance 4 Your Life! (“D4YL“), a collaboration between the Larry King Cardiac Foundation (“LKCF”) and the Dizzy Feet Foundation (“DFF”) (collectively, “Owners” or “we,” “our,” or “us“). This privacy policy (“Privacy Policy“) applies to this web site (however accessed and/or used), all other web sites owned and operated by us that post this Privacy Policy, and other interactive features and applications that are accessible or downloadable though our web sites and post this Privacy Policy (collectively, our web sites and the interactive features and applications are referred to as the “Site“). This Privacy Policy describes our information and privacy practices with regard to the Site, such as the types of information we may gather from you and other visitors to the Site and how we may use and share that information. Except as specifically stated otherwise, this Privacy Policy applies only to information collected on this Site and does not apply to any information collected at any other web site or offline by Owners (unless specifically stated). Please review this Privacy Policy carefully. In addition, please review the Site’s Terms of Use, which govern your use of the Site.

1. Data We Collect.

1.1 Collection of Personal Data and Demographic Information. “Personal Data” is information that would allow someone to identify you personally. The types of Personal Data we may collect from you via the Site will vary depending on the activity involved, but may include: first and last name, physical address, e-mail address, birth date, mobile phone number, and home phone number. We do not require that you provide Personal Data to obtain access to public parts of the Site. However, some areas of the Site may ask you to submit Personal Data in order for you to benefit from the specified features or to participate in a particular activity. For example, we may collect Personal Data (i) in connection with registration on the Site; (ii) participate in games, contests, sweepstakes, events, or other promotional events (collectively, “Promotions“) offered through the Site; (iii) subscribe to newsletters, email updates, e-blasts, or other communications; (iv) send questions or comments to us; and/or (v) fill out online surveys or participate on message boards. Providing us with Personal Data about yourself is voluntary, and you can always choose not to provide certain information, but then you may not be able to take advantage of or participate in certain of the Site’s features. Also, we may ask you to provide us with demographic information, such as gender, zip code, or similar information (“Demographic Information“). We may collect Demographic Information when we ask you to submit Personal Data. If we combine Demographic Information with the Personal Data we collect, we will treat it as Personal Data under this Privacy Policy.

1.2 Donations. When you make a donation through the Site, we may ask you to submit certain Personal Data such as credit card information so we can process your donation. We use the credit card information you provide only to fulfill the transaction you requested. We maintain your Personal Data in our records so we can contact you to provide D4YL program information and information on additional giving opportunities.

1.3 Promotions. Our Site occasionally may contain notices of Promotions we are conducting, which you may enter electronically in some cases. We use the information you provide to conduct the Promotion (for example, to contact you if you are a winner). We also may use Personal Data collected in connection with a Promotion in fundraising appeals, email campaigns, and personalized web experience.

1.4 Contacting D4YL. You may choose to contact us through the Site. We provide online forms so you may, for example, (1) ask a question, (2) update your address, or (3) request more information. We use the information you provide on these forms to fulfill your request. We use the information you provide to respond to your inquiries.

1.5 Collection of Information From Third Parties. From time to time, we may obtain Personal Data that has been collected by third parties. For example, our partners or sponsors may provide us with information, including Personal Data, about users that choose to participate in a promotional opportunity the partner or sponsor is offering in connection with us. We may use such Personal Data we receive from those sources with information we have collected from you on the Site. In such cases, we will apply this Privacy Policy to any Personal Data received, unless we have disclosed otherwise. However, because this information is not collected on the Site, we are not responsible for the accuracy of this data or how such third parties collect and use such data.

2. Passive Collection of Non-Personal Data. In addition to any Personal Data or other information that you choose to submit to the Site, we and our third-party service providers may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the Site (“Non-Personal Data“). This Non-Personal Data may include the browser you are using, the URL that referred you to our Site, all of the areas within our Site that you visit, and the time of day, among other information. We may use Non-Personal Data for a variety of purposes, including to enhance or otherwise improve the Site. In addition, we collect your IP address or other unique identifier (“Device Identifier“) for your computer, cell phone, or other device (any, a “Device“) used to access the Site. A Device Identifier is a number that is automatically assigned to your Device used to access the Site, and our computers identify your Device by its Device Identifier. Non-Personal Data may be non-identifying or may be associated with you. Whenever we associate Non-Personal Data or a Device Identifier with you, we will treat it as Personal Data. The methods that may be used to collect Non-Personal Data include the following:

2.1 Cookies. A cookie is a data file placed on a Device when it is used to visit the Site. A flash cookie is a data file placed on a Device via the Adobe Flash plugin that may be built-in to or downloaded by you to your Device. Cookies and flash cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to our web pages. If you choose to disable cookies and flash cookies on your Device, some features of the Site may not function properly.

2.2 Web Beacons. Small graphic images or other web programming code called web beacons (also known as “1×1 GIFs” or “clear GIFs”) may be included in our web pages and e-mail messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.

2.3 Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

3. The Way We Use Personal Data, Demographic Information and Non-Personal Data.

3.1 We retain and may use your Personal Data, Demographic Information or Non-Personal Data (collectively, “Information“) for many purposes, including:

3.1.1 to send newsletters and other communications for which you have subscribed or agreed to receive;

3.1.2 provide you with services or fulfill transactions that you have requested;

3.1.3 send you offers or promotional materials on behalf of Owners or third parties;

3.1.4 communicate with you regarding information, features, or offers that we believe will be of interest to you;

3.1.5 contact you regarding a Promotion in which you have participated;

3.1.6 respond to your questions or other requests;

3.1.7 contact you with regard to your use of the Site, including, without limitation, changes to the Site’s Privacy Policy, Terms of Use or other Site policies;

3.1.8 to improve or customize the Site and its content, features, and services;

3.1.9 allow you to access specific sections of Site for which you have registered; or

3.1.10 for other internal business purposes or for other purposes disclosed at the time you provide your Personal Data or as otherwise set forth in this Privacy Policy.

3.2 Additionally, where you have submitted information to us through the Site via a “contact us” or other similar mechanism, we will not use the information submitted by you to contact you for marketing purposes unrelated to your request unless you agree otherwise.

3.3 Please note that in accordance with our routine record keeping, we may delete certain records that contain Personal Data you have submitted through the Site. We are under no obligation to store such Personal Data indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Data. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

4. How We Share Information. We may disclose Information with third parties or nonaffiliated companies under the following circumstances:

4.1 Service Providers. We may share Information with third party vendors who perform certain services on behalf of the Site, such as designing and/or operating the Site’s features, tracking Site analytics, enabling Owners to send you communications and performing other administrative services.

4.2 Marketing Purposes. There may be instances on the Site, such as in connection with a sweepstakes sponsored by or co-branded with a third party, where we may ask you if you would like us to share Personal Data with a particular party for their marketing purposes. We will share your Personal Data with that third party for marketing purposes only where you have opted in or otherwise indicated your consent. Please note that when you agree that we may share your Personal Data with a third party for marketing purposes, your information will be subject to that third party’s privacy policy. Therefore, you will need to contact that third party directly if you later decide that you do not want that third party to use your Personal Data.

4.3 Sale/Reorganization. We reserve the right to disclose and transfer Information about you (and you consent to such disclosure and transfer): (i) to a subsequent owner, co-owner, or operator of the Site, including any applicable database; or (ii) in connection with a merger, consolidation, restructuring, dissolution, reorganization, the sale or transfer of substantially all of either Owner’s stock and/or assets, or other corporate change, including, without limitation, during the course of any due diligence process.

4.4 Legal and Safety Obligations. We may disclose your Information: (i) if we are required to respond to subpoenas, court orders, legal process, or other valid law enforcement measures; (ii) at the request of governmental authorities conducting an investigation; (iii) when we believe in good faith that the law requires disclosure; (iv) to verify or enforce compliance with the Site’s Terms of Use or other policies governing the Site; (v) whenever we believe disclosure is necessary to limit our legal liability or to protect or enforce the rights, interests, or safety of the Site, visitors to the Site or other third parties; or (vi) to respond to an emergency.

4.5 Unlawful Access. Your Information may be disclosed to third parties (e.g., hackers) who unlawfully intercept or access Information or confidential transmissions.

4.6 Promotions. If you choose to sign-up for a Promotion offered on the Site, your Personal Data may be disclosed to third parties in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. By entering a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, without limitation, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, and/or performance in advertising or marketing associated with the Promotion.

4.7 Advertisers. We may disclose Demographic Data and Non-Personal Data, such as aggregate user data, to advertisers, business partners, and other third parties.

4.8 Submissions. Pursuant to the Submissions Policy of our Terms of Use, we may publish your name, voice, likeness, performance, and other Personal Data in connection with any submissions you may make to the Site.

5. Participating in Public Forums. The Site may provide chat rooms, message boards, comments pages, and other “public” forums for sharing information or discussing various topics (collectively, the “User Forums“). Please keep in mind that whenever you give out Personal Data in a User Forum, that information can be collected and used by people you do not know. If you choose to voluntarily disclose information in a User Forum, the protections of this Privacy Policy will not cover such disclosure of information. We urge you to use caution when disclosing any Personal Data on a User Forum. We are not responsible and will not be liable for any opinions, content, or other materials posted by visitors in any such User Forum, or for the use by other Site visitors or third parties of any information or content you may post to such User Forums. Your use of User Forums is subject to our “Acceptable Use Policy” and other provisions of the Terms of Use.

6. Linking to Third Party Web Sites. The Site may contain links to third-party web sites, which may provide additional information, goods, services, and/or promotions. For example, you may encounter links from sponsors or partners, which may include Owners’ logo or other identifying marks as part of a sponsorship, partnership, marketing, and/or co-branding arrangement. These third party web sites are owned and operated independently of Owners and may have their own separate privacy and data collection practices. Owners have no responsibility or liability whatsoever for the actions or policies of these independent web sites and are not responsible for the content or privacy practices of such web sites, even where Owners have entered into a sponsorship, partnership, marketing, and/or co-branding agreement with the third party web site.

7. Communications; Unsubscribe. Users who receive a newsletter or other promotional/ marketing communications from us and who wish to remove themselves from our mailing lists can do so by following the link provided in the communication received. However, even if you opt-out from receiving our newsletters or other marketing/promotional communications from us, we reserve the right to send you certain communications relating to our Site, such as service announcements, notices of changes to this Privacy Policy or our Terms of Use, or similar administrative or transactional messages, without offering you the opportunity to opt-out of receiving such messages.

8. Advertisements on the Site. Advertisements from third party advertisers (“Advertisers“) may appear on the Site. Advertisers may compile information about the advertisements that appeared to you on the Site or others using your Internet Device and which advertisements you, or others using your Internet Device, access. The Advertisers may use cookies, web beacons, embedded scripts, and other methods of passively collecting Non-Personal Data. The collection of Non-Personal Data through these methods may allow the Advertisers to track each time you are sent an advertisement from that Advertiser. These Advertisers may use this information to deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy does not cover these methods for collecting information by these Advertisers or the use of the information collected by the Advertisers.

9. Data Security. We incorporate commercially reasonable safeguards to help protect and secure your Personal Data. However, no data transmission over the Internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use our Site and provide us with your information at your own risk.

10. Children Younger than 13 Years. This Site is a general audience web site that does not knowingly collect Personal Data from children younger than 13 years of age (“Child” or “Children“). If you are a Child, please do not send any information about yourself to us. If we are notified that a Child has submitted Personal Data to us, we will delete that Child’s Personal Data.

11. Visitors Residing Outside The United States And Consent To Transfer. Visitors who use the Site and reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you are located in the European Union, Canada, or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Site or providing us with your information, you fully understand and clearly and intentionally consent to this Privacy Policy and to the collection, storage, and processing of such information in the United States.

13. Changes To The Privacy Policy. Owners reserve the right to change this Privacy Policy at any time without notice to you. However, Owners will not use your Personal Data in a manner materially different than what was stated at the time it was collected without your consent.
